Terms of Service
The terms that apply when you use Habitale.
These Terms of Service govern your use of Habitale, a habit tracking app for iOS. By downloading or using Habitale, you agree to these terms. If you do not agree, please do not use the app.
1. About Habitale
Habitale is a personal habit tracking tool. It lets you create habits, choose the unit each habit is measured in, set daily, weekly, and monthly goals, log your progress, follow streaks and insights, and read reports for completed periods.
Habitale records and organizes what you tell it. It does not observe your behavior on its own.
2. Not Medical or Professional Advice
Habitale is a tracking tool, not a medical, psychological, therapeutic, nutritional, fitness, or other professional service. Nothing in the app is medical or professional advice, diagnosis, or treatment.
Do not use Habitale as a substitute for advice from a qualified professional. If you have concerns about your health or wellbeing, speak with a qualified professional.
3. No Guarantee of Outcomes
Habitale does not guarantee any behavioral, personal, health, or performance outcome. Tracking a habit does not guarantee that you will keep it, and the app makes no promises about results.
4. Personal Use
Habitale is licensed to you for personal, non-commercial use on devices you own or control. You may not resell, redistribute, or offer the app as a service to others.
5. Your Habit Information
The habits you create, the entries you log, and the goals you set are yours. You are responsible for what you enter and for making sure it is accurate.
Please do not enter information you would not want stored on your device, synced to your account if you sign in, or sent to Milo if you use the assistant.
6. Habit and Goal Tracking
Progress, goal completion, and streaks are calculated from the entries you log and from the goals active at that time. Editing, deleting, or backdating entries, or changing a goal, will change the values the app shows.
7. Milo and AI Features
Milo is an AI assistant that helps you log habit updates. The following limits apply:
- Milo matches your message against your active habits and suggests updates; it does not create habits or record entries on its own.
- Suggestions can be wrong, incomplete, or missing. Review them before you confirm.
- Milo is not a coach, therapist, or advisor, and it does not tell you which habits to build.
- AI features depend on a network connection and on a third-party AI service, and may be unavailable, delayed, or rate limited.
You are responsible for confirming any suggested update before it is saved.
8. Local Data and Synchronization
Habitale stores your habit data on your device. Signing in with Apple is optional and enables backup and synchronization of that data.
Synchronization depends on a network connection and on the availability of the service, and is not guaranteed to complete instantly or without conflict. Deleting the app without signing in first may remove habit data that was never backed up. You are responsible for keeping your own backups, including exported files.
9. Reminders and Notifications
Reminders are delivered as local iOS notifications and require notification permission. iOS may delay, group, or suppress notifications depending on Focus modes, notification summaries, and system settings, so Habitale cannot guarantee delivery at an exact time.
10. Reports and Calculated Insights
Charts, averages, streaks, records, and weekly, monthly, and yearly reports are calculated from the entries you logged. They are provided for your own reference only and should not be relied on for medical, financial, or professional decisions.
Reports are generated for completed periods that contain logged activity.
11. Data Export and Import
Habitale lets you export your habit data and import habit data from a compatible file. Once a file leaves the app, you are responsible for where it is stored and who can access it.
Importing may add to or change your existing habit data. Review a file before importing it.
12. Premium Subscriptions and Purchases
Habitale offers a premium subscription that unlocks features such as the AI assistant, unlimited habits, and data backup. Available features, prices, and plans may change.
Purchases are processed by the Apple App Store and charged to your Apple Account. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
You can manage or cancel a subscription in your Apple Account settings. Refunds are handled by Apple according to Apple’s policies. If a purchase is not recognized, use Restore purchases while signed in with the same Apple Account used to buy it.
13. Availability and Changes
We may add, change, or remove features, and we may require an updated version of the app in order to keep certain features working. Services the app depends on may be unavailable at times.
14. Prohibited Conduct
You agree not to:
- Use Habitale in a way that breaks any applicable law
- Attempt to reverse engineer, decompile, or interfere with the app
- Attempt to bypass premium access, purchase verification, or usage limits
- Disrupt, overload, or abuse the app’s services, including the Milo assistant
- Submit content that is unlawful, abusive, or infringing through feedback or AI requests
- Use automated systems to access the app’s services in an unintended way
15. Disclaimer
- Habitale is provided “as is” and “as available”, without warranties of any kind.
- We do not warrant that the app will be uninterrupted, error free, or free of data loss.
- We do not guarantee that reminders will be delivered at an exact time.
- We do not guarantee that calculated insights, reports, or AI suggestions are accurate or complete.
16. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of habit data, arising from your use of Habitale.
Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim.
17. Privacy
Your use of Habitale is also covered by our Privacy Policy, which explains what stays on your device and what is sent to the services that run the app.
18. Changes to the Terms
We may update these terms from time to time. When we do, we will update the date above. Continued use of Habitale after changes means you accept the updated terms.
